The petitioner, who have been summoned to participate in the enquiry on the complaint given by one Kesavan, S/o. Shanmugavelu, is before this Court stating that the petitioner been harassed by the police by causing repeated summons.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that two complaints received by the police against this petitioner for cheating the complainants promising to get Central Government job. Inspite of receiving summons to participate in the enquiry, the petitioner has come before this Court alleging that police is harassing.

The learned Government Advocate (Crl.Side) further submits that so far two complaints received against this petitioner for cheating adopted the same MOP, the petitioner is absconding and not cooperating with the enquiry. If the petitioner participate in the enquiry, the true facts can be found out whether to proceed further on the complaint.

Taking note of the fact that the petitioner is not submitting himself for enquiry and approached this Court alleging that the police is harassing him, this Court is of the view that this Criminal Original Petition to be dismissed with direction to the respondent police to act in accordance with law and proceed as per the directions of the Hon'ble Supreme Court in case of investigating financial fraud. 03.10.2024 2/4
