ORDER
The petition has been filed seeking a direction to the Respondents not to dig the Petitioners land in Survey No. 157/6E in Plot No. 18 in Patta No. 4659 of Vengikal Village, Thiruvannamalai District without resorting to any Land Acquisition Proceedings.
2. The case of the petitioner is that the petitioner is the owner of the property in S.No.157/5 and 157/6 measuring about 1200 sq. ft. situated at Vengikal Village. However, without any acquisition proceedings, the respondents have tried to encroach the petitioner's property for construction of storm water drainage system. The petitioner made several representations to the respondents and however, till date, the same was not considered. Hence, the petitioner filed the present writ petition before this Court seeking appropriate directions.
3. When the matter is taken up for hearing, the learned Addl. Government Pleader submitted that a similar situated person has already been filed a writ petition before this Court in W.P.no.29592/2022 and this Court was also granted an interim order to maintain status quo and therefore, the project has been stopped. Hence, there is no apprehension for interfering with the petitioners property and no further order is necessary in this Writ petition.
4. Recording the above submission made by the learned Addl. Government Pleader, the writ petition is closed. However, liberty is granted to the petitioner to work out his remedy in the manner known to law. No costs. Consequently, connected miscellaneous petition is also closed.
