O R D E R

The writ petition has been filed for the following reliefs:- "Directing the respondents to fix his basic pay in pay matrix at Rs.56900 /- in the pay Band of Rs.35400- 112400 effective from 01.11.2021 on sanction of Vth level review and to regulate the subsequent annual increments till his retirement on 31.05.2025 and pay the arrears with 10 percent interest along with the revised terminal benefits within the time that may be stipulated by this Honble court."

2. The petitioner's contention is that he had joined the services of the respondent corporation as a Junior clerk on 23.05.1998 and retired as a Senior Assistant on 31.05.2025. On 24.08.2022, the 14th wage settlement 2/5

was entered into and the benefits under the said settlement came into effect from 01.09.2019. The petitioner's basic pay as on 31.08.2019 was Rs.45,900/- which was revised and refixed in a new pay matrix at Rs.49,000/- with effect from 01.09.2019. Taking into consideration of his annual increments sanctioned is every November his subsequent basic pay was accordingly fixed and as on 01.11.2021, his basic pay was fixed at Rs.53,600/-. On 01.01.2021, he was also sanctioned the Fifth level review of pay which carries 3% of the monetary value of the existing basic pay of Rs.53,600/-. Therefore, the additional 3% of the existing basic pay (ie.Rs.1,608/-) has to be added to Rs.53,600/- to arrive at a new basic pay of Rs.55,208/-.

Since there was no berth for this amount in the pay matrix, it has to be fixed at the next stage in the pay matrix ie. Rs.56,900/-. The respondents have however reduced a sum of Rs.8/- from the increased amount of Rs.1608/- and added only Rs.1,600/- and fixed the basic pay at Rs.55,200/- and this anomaly continued till the petitioner's retirement. The petitioner had given several representations to correct the same. However, since the representations have not been considered, the petitioner is before this Court.

Though the Writ Petition is filed for the relief stated supra, however, considering the facts and circumstances of the case, the Writ Petition is disposed with a direction to the respondents to consider the representation of the petitioner dated 09.02.2024 and the reminder dated 31.05.2025 and pass orders on the basis of the extant rules, within a period of 2 months from the date of receipt of a copy of this order. The petitioner shall be given a personal hearing before passing the order.
