ORDER
The petitioner, who was arrested and remanded to judicial custody on 12.12.2024 for the alleged offences under Sections 427, 452, 302, 109, 120B, 34, 147, 148 and 341 of IPC, in connection with S.C.No.81 of 2024, on the file of respondent police, seeks bail.
2.The learned counsel for the petitioner submitted that the petitioner had earlier been granted bail, which was subsequently cancelled. Thereafter, as he failed to appear for one of the hearings before the Court, he was remanded. Though the petitioner has previous cases, before the Sessions Court he placed his contentions and was granted bail. Therefore, he submits that the bail was granted on merits, and hence, he prays for grant of bail in the present petition.
3. The learned Government Advocate (Crl. Side) raised an objection, stating that the petitioner is arrayed as A1. A Non-Bailable Warrant (NBW) was issued against him on 20.12.2024 and executed on the same day. Originally, the petitioner had been granted bail on 20.06.2024. However, he is a history-sheeter with 21 previous cases, including two murder cases. Even after being released
on bail, he attacked one of the witnesses in a pending case, leading to the registration of another case and cancellation of his bail.
4. Considering the petitioner's bad antecedents and his conduct, if released on bail, there is a likelihood that he may abscond, tamper with evidence, and intimidate witnesses. Therefore, this Court is not inclined to grant bail to the petitioner.
