The petitioner seeks anticipatory bail in Crime No.9 of 2022, registered under Sections 66(C) and 66(D) of Information and Technology Act, 2000 and Sections 420, 419 and 468 of IPC, FIR had been registered on 2.12.2022. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing on behalf of the respondent. 3.It is the specific case of the respondent that the de facto complainant had applied for a job in Queenstown Mall at New Zealand and for that purpose, all the accused persons had, in intervals received amounts from the de facto complainant totally amounting to Rs.6,83,050/-. It is very specifically stated that on 21.11.2022 a sum of Rs.68,000/- and on 29.11.2022 another sum of Rs.

68,000/- were utilised through POS machine at COCO KR Puram II vide terminal ID IO023550 and IO024242 respectively. It was said that this was evident from the account no.3883755513. Further investigation revealed that COCO KR Puram II is a petrol bunk at Mahadevarapura in Bangalore and the POS machine was linked with Axis bank account No.918020018642515 which is in the name of the petitioner herein.

kp 4.It is the contention of the the learned counsel for the petitioner that the respondent had issued notice under Section 41A of Cr.PC., and the petitioner had also gone over to the respondent and he was threatened to return back Rs.1,36,000/- and that he had transferred a sum of Rs.68,000/- on two separate occasions to one Ezhumalai, Sub Inspector of Police. I am not able to understand that particular statement but the respondent will have to answer that aspect during the course of trial.

5.Primarily, the amount transferred by the de facto complainant had flown into the account of the petitioner herein. Further investigation will have to be done at this stage. In view of the contrary statements and giving the petitioner every opportunity to raise issues about the amount transferred to Ezhumalai, Sub Inspector of Police, anticipatory bail petition stands dismissed. 6.Accordingly, the anticipatory bail petition stands dismissed. 06.11.2023 kp 2/3
