The petitioner who was arrested and remanded to judicial custody on 04.09.2022 for the offence punishable under Sections 394 & 397 IPC in Cr.No.312 of 2022, seeks bail.

2. The case of the prosecution is that on 04.09.2022, the accused had waylaid the defacto complainant and by threatening him at knife point, snatched a sum of Rs.2,200/- from him. Hence the complaint. 3.The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence prays for grant of anticipatory bail. 4.The learned Government Advocate (Crl.Side) would submit that this is the second bail petition and the earlier petition has been dismissed by this Court in Crl.O.P.No.25205 of 2022, on the ground that the petitioner is a habitual offender and having 14 previous cases including four https://www.mhc.tn.gov.in/judis

anu 302 IPC cases. Therefore, if the petitioner is released on bail, there is a possibility of absconding. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the gravity of offence committed by the petitioner and that there are several previous cases pending against the petitioner, including four 302 IPC cases, this court is not inclined to grant bail to the petitioner.
