ORDER

Heard the learned counsel for the petitioner.

2. The appellant was set ex parte before the Tribunal and due to administrative exigencies, delay of 597 days occurred in preferring this Civil Miscellaneous Appeal.

3. The learned counsel for the petitioner would contend that steps have been taken to set aside the ex parte order passed against the Insurance Company before the Tribunal and in that regard, an interim application is also pending before the Tribunal.

4. Despite the receipt of notice, the first respondent neither appeared nor entered appearance through his counsel. Notice sent to the second respondent /owner of the vehicle has been returned as "unclaimed".

5. Accepting the averments made in the petition, this petition shall stand allowed on payment of cost of Rs.500/- payable in favour of the Cancer Institute (WIA), Gandhi Nagar Canal Bank Road, Adyar, Chennai - 20 (payable in S.B.A/c.No.149710011000002, Union Bank of India, Madhya Kailash Branch, Cancer Institute (WIA) Campus, Sardar Patel Road, Chennai-36, Branch Name and Code : 1497, MICR No.600011049, IFSC Code : UBIN0814971), on or before 17.04.2026.
