ORDER
This Criminal Original Petition has been filed to direct the respondents not to harass the petitioners under the guise of enquiry.
2. It is submitted by the learned counsel appearing for the petitioners that a complaint has been preferred against the husband of the first petitioner and father of the second petitioner. The grievance of the petitioners is that the petitioners are asked to come to the police station for enquiry. Hence, this Criminal Original Petition.
3. The very First Information Report indicate that it is only a contractual issue between the defacto complaint and the husband of the first petitioner.
When the First Information Report has already been registered, this Court is at loss to understand why the wife and children are required in the police station. If at all their presence is required, proper summons under section 35[3] of BNSS has to be issued to the parties and there shall not be any harassment.
