Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 1st respondent to transfer the case in Crime No.979 of 2007 pending on the file of 4th respondent to CBCID or any other independent agency for speedy investigation and to file a final report within specified time limit.

ORDER

This petition has been filed seeking to transfer the investigation in Crime No.979 of 2007 pending on the file of the 4th respondent.

2. The 4th respondent has registered an FIR for the offences under Section 457, 350 and 511 of IPC. Since there was no progress in the investigation and none of the accused persons was secured and the stolen articles were not recovered, the present petition has been filed seeking for transfer of investigation.

3. Taking into consideration the facts and circumstances of the case, there shall be a direction to the Assistant Commissioner of Police, Ashok Nagar, Chennai to monitor the investigation conducted by the 4th respondent. The 4th respondent shall effectively carry on with the investigation and file a final report after securing the accused persons and recovering the stolen articles, as expeditiously as possible.

4. This Criminal Original Petition is disposed of with the above directions.
