ORDER

The petitioner herein apprehends arrest at the respondent for the alleged offences punishable under Sections 303(2), 238(c) and 326(b) of BNS read with 1 / 4

Sections 21(1) of Mines and Minerals (Development and Regulation)Act, 1957 in Crime No.507 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that sand was stolen from the land of the defacto complainant occurred without his permission and permit. Hence, the case.

3. The learned counsel appearing for the petitioner submits that the petitioner was engaged by the ward member and, being the driver of the vehicle, he is not aware of the ownership of the land, from which the sand was excavated.

4. On considering the facts of the case, this Court is not inclined to grant anticipatory bail, since the custodial interrogation of the petitioner is required to prove the complaint. Accordingly, this Criminal Original Petition is dismissed. 19-08-2025 drl 2 / 4
