JUDGMENT

Today, when the matter was taken up for hearing, the learned counsel for the appellant submitted that the sole appellant has died on 21.01.2010.

2. As far as this case is concerned, the appellant has died as early as in the year 2010, however, till date, no steps have been taken by the appellant's counsel to implead the legal representatives of the deceased appellant. Hence, this Civil Miscellaneous Appeal is dismissed as abated. However, liberty is granted to the legal representatives of the deceased appellant to restore this Appeal. No costs.
