4.

The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that due to property dispute, the petitioners along with other accused trespassed into the property of the defacto complainant, attacked him and his friends with wooden log, iron rod and also threatened him. He further submitted that the injured has been discharged from the hospital and there is one previous case against the 4th petitioner and there is no previous case against the other petitioners. He also submitted that the prime accused in this case has been arrested and detained under Goondas. Hence, he opposed for grant of anticipatory bail to the petitioners.

5. Considering the submission of the learned counsel on either side and also taking note of the fact that the injured has been discharged from the hospital and though there is one previous case against the 4th petitioner, he was released on bail in that case and there is no previous case pending against the other petitioners and also of the fact that the prime accused has been arrested and detained as Goondas, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.
