The petitioner is the 4th accused in Crime No.194 of 2023, registered under Section 6 r/w 20(1) COTPA Act, 2003 and Section 328 of IPC.
2.It is stated that the vehicle belonging to the petitioner bearing Reg.No.TN 38BE 2224, TOYOTA FORTUNER coming from Bangalore to Krishnagiri was checked by the respondent and it was found that banned Tobacco product worth Rs.1,99,920/- available in the Vehicle. The petitioner is the 4th accused and the 1st accused had been taken into custody and had been granted bail by the learned Single Judge of this Court in Crl.OP.No.18875 of 2023 dated 22.8.2023. However, it is seen that A2 and A3 are absconding. They are the driver and the other occupant of the Car. The petitioner had lent out his Car for that particular purpose he must also be aware about the presence of A2 and A3, who were the driver and occupant. 3.It is stated on behalf of the respondent that the person who had actually supply the contraband will have to be found out and in view of that particular fact, further investigation is required, particularly since the contraband was seized on the vehicle belonging to the petitioner herein. https://www.mhc.tn.gov.in/judis 1/2
