This Writ Petition has been filed seeking a direction to the first respondent to consider the written representation of the petitioner dated 21.07.2025 and inquire into the affairs, working and financial condition of the second respondent, facilitate the conduct of the Extra Ordinary General Meeting of the second respondent as per its Bye Laws.
2. Heard the learned counsels on either side.
3. The brief facts of the case is as follows: 3.1. The petitioner is the member of the second respondent i.e. Coimbatore Malayali Samajam [hereinafter referred to as "Samajam"] which was established in the year 1956 and registered under the Tamil Nadu Societies Act, 1975. As per its Bye laws, the society was formed for, amongst other things, to work for the educational, cultural, artistic and social advancement of Malayalies residing in the city of Coimbatore. The petitioner made a written representation to the first respondent on 21.07.2025 to consider his representation and inquire into the affairs, working and financial condition of the second respondent, facilitate the conduct of the Extra Ordinary General Meeting of the second respondent as per its Bye Laws.
Since the same was not considered, the present writ petition has been filed.

The learned counsel for the petitioner submitted that the petitioner made a written representation to the first respondent on 21.07.2025 regarding the mismanagement of the second respondent, however there was inaction on the part of the first respondent. He further submitted that during the pendency of the present petition, in an identical matter, this Court by its order dated 28.10.2025, had directed the first respondent to consider the petitioners' representation therein and pass orders within 12 weeks from the said order. He added that pursuant to the said order, the petitioners therein were called upon for enquiry by the first respondent on 18.11.2025 and hence, requested to issue a direction to the petitioner herein to participate in the enquiry along with the other members of the second respondent Samajam.

Considering the submissions made by the learned counsel for the petitioner and in the light of the order passed by this Court in W.P.No.40283 of 2025 dated 28.10.2025, the first respondent is directed to permit the petitioner to participate in the enquiry which is scheduled to be held on 18.11.2025. The first respondent is directed to hear the petitioner along with the other members and the second respondent in regard to the representation
dated 21.07.2025 and pass appropriate orders in terms of the direction issued in W.P.No.40283 of 2025 dated 28.10.2025.
6. With the above directions, the Writ Petition is disposed of. Consequently, connected Miscellaneous Petitions are closed. There shall be no orders as to costs.
