The condition imposed in para 9 in Crl.M.P.No.4 of 2025 in C.A.No.306 of 2023 by the trial Court dated 18.07.2025, is put under challenge in the present Criminal Original Petition and the petitioners seek modification of the said condition.

2. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl. Side) appearing on behalf of the second respondent.

3. The learned counsel for the petitioners submitted that the cost imposed by the trial Court in M.P.No.4 of 2025 in C.A.No.306 of 2023 dated 18.07.2025 may be reduced. He further submitted that the petitioners are

ready to pay a sum of Rs.20,000/- as costs.

4. Considering the nature of allegations and period of the complaint and also taking into account, the age of the first respondent, this Court is inclined to modify the condition imposed by the trial Court to the effect that a sum of Rs.20,000/- has to be paid as costs to the first respondent as accepted by the petitioners, within a period of one week from the date of receipt of a copy of this order. It is also made clear that on failure to comply with the order of this Court, the respondent police shall proceed as per law.
