The learned Special Government Pleader, Mr.A.Selvendran would submit that actions are initiated to remove the remaining encroachments in that locality. He seeks three weeks time to complete the process of removal of encroachments in that locality. In view of the said request, we are inclined to grant three weeks of time to remove all the encroachments in that locality.
2. It is needless to state that under the Revenue Standing Orders, while removing encroachers from the Government properties, the Government is empowered to recover Use and Damage charges. The period of usage and the area of occupation are to be determined and consequently, appropriate actions are to be initiated to recover the Use and Damage and compensation, if any further damage has been done to the Government property. Such an action also is to be initiated by the competent authority in order to discourage the encroachments on public property, which would result in infringement of the public rights.
3. Accordingly, this petition stands allowed and the Contempt Petition stands reopened.
