Writ petition is filed under Article 226 of the Constitution of India, pleased to issue writ of mandamus, directing respondent No.1 to 3 to refix the pay of the petitioner by adopting 2.57 multiplier/ Matrix on par with 7 th pay revision from the date of promotion with subsequent increments and to revise the terminal benefits accordingly within a stipulated time prescribed by this Hon'ble Court pursuant to the representation dated 17.07.2025 and pass. ORDER
Mr.Yogesh Kannadasan, learned Special Government Pleader takes notice for the respondents. With the consent of both the learned counsels, the main writ petition is takenup for final disposal.
2. The above writ petition is filed for issuance of a writ of mandamus, directing respondent No.1 to 3 to refix the pay of the petitioner by adopting 2.57 multiplier/ Matrix on par with 7 th pay revision from the date of promotion with subsequent increments and to revise the terminal benefits accordingly within a stipulated time prescribed by this Court pursuant to the representation dated 17.07.2025.
3.The case of the petitioner is that he joined the respondent Corporation on 01.05.1986 as Junior Tradesman and after rendering 49 years of service, he 2/5
retired from service on 30.06.2025 as Junior Engineer. The grievance of the petitioner is that upon his promotion on 29.02.2016, he is entitled to pay fixation as per G.O.Ms.No.134, Transport Department, dated 09.04.2018. However, based on G.O.Ms.No.330 dated 31.10.2018 of the very same Department, the petitioner's pay was fixed using the Multiplier 2.44 instead of 2.57. Hence, the petitioner sent a representation to the respondents on 17.07.2025. Since the said representation has not evoked any response, the petitioner has filed the above writ petition for the aforesaid relief. 4.The learned counsel for the petitioner would submit that it would suffice if a direction is issued to the respondents to consider and dispose of the petitioner's representation dated 17.07.2025 within a time frame to be fixed by this Court.
4.Heard both sides and perused the materials placed on record. 5.Under the facts and circumstances of the case and considering the limited prayer sought for by the learned counsel for the petitioner, a direction is issued to the respondents 2 and 3 to consider and dispose of the petitioner's representation dated 17.07.2025, on merits and in accordance with law, withina 3/5
period of eight weeks from the date of receipt of a copy of this order. It is made clear that this Court has not made any observations on the merits of the case. 6.The writ petition is disposed of accordingly. No costs.
