ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.10.2024, for the alleged offence under Sections 9 (m) and 10 of POCSO Act, 2012, in Crime No.38 of 2021, registered on the file of the respondent, seeks bail.

2.The learned counsel for the petitioner submits that the petitioner was initially arrested on 23.12.2021 and the bail was granted on 21.02.2022. He further submits that the petitioner was released on bail by the trial Court on 23.02.2022. However, a Non-Bailable Warrant was issued against the petitioner on 15.02.2024 for his non appearance, and he was subsequently arrested on 29.10.2024. He further submits that the petitioner is willing to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

3.The learned Government Advocate (Criminal side) submits that the case pertains to the year 2021. Due to the non-appearance of the petitioner, an NBW issued on 15.02.2024, and the same was executed on 29.10.2024. He further submits that out of fourteen witnesses, eleven have already been examined and only three witnesses are to be examined. 4.Heard the learned counsels on either side and perused the records. 5.It is seen that the petitioner is in the habit of jumping bail and not cooperating with the trial. If he is released bail, there is a likelihood of his absconding once again. Therefore, at this stage, this Court is not inclined to grant bail to the petitioner. The trial Court is directed to dispose of the case in 2/4

Crime No.38 of 2021 within a period of two months from the date of receipt of copy of this order. Accordingly, this Criminal Original Petition stands dismissed.
