When the matter was taken up for hearing, affidavit of the respondent was filed and the relevant portion is extracted hereunder: "

It is submitted that based on the above order, the petitioner filed copy application before the learned Special Court for trial cases under SC/ST Act (POA), Vellore on 22.07.2024 in C.A.No.1106 of 2024 praying to issue the certify copy of the mistake of fact report and investigation report submitted by the respondent in R.C.S.Notice No.1 of 2024 for filing of protest petition.

8. It is submitted that after the order passed in Crl.O.P.No.1845 of 2024 by the Hon'ble High Court, Madras, the learned Special Court for trial cases under SC/ST Act (POA), Vellore has returned the final report due to some corrections on various time and the same was rectified and submitted as additional final report before the learned Special Court for trial cases under SC/ST Act (POA) Vellore on various dates ie., 31.03.2024, 28.06.2024, 08.07.2024, 18.09.2024 and 20.09.2024.

9. It is further submitted that on 25.09.2024, the Deputy Superintendent of Police rectified the mistakes and filed Additional Final Report before the learned Special Court for trial cases under SC/ST Act (POA), Vellore vide E-Filing No.LTN 20230002156C202400319 and the RCS notice was served to the de-facto complainant through court vide RCS No.6 of 2024. The next date of hearing on 07.12.2024 for issue notice to the de-facto complainant through Special Public Prosecutor."
