Prayer: Writ Petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to consider the representations of the petitioners dated 14.10.2019 and 09.10.2019 respectively by declaring the pass result of the petitioners in the grade II Constable examination results 2019 and permitting the petitioners to joining the further course of grade II Constable recruitment 2019 to secure the ends of justice. Mr.V.Kadirvelu Special Government Pleader C O M M O N O R D E R Writ petitions are filed for issuance of Writ of Mandamus directing the respondent to consider the representations of the petitioners dated 14.10.2019 and 09.10.2019 respectively by
declaring the pass result of the petitioners in the grade II Constable examination results 2019 and permitting the petitioners to joining the further course of grade II Constable recruitment 2019 to secure the ends of justice. 2.Heard the learned counsel appearing for the petitioners as well as the learned Special Government Pleader appearing for the respondent.
3.The case of the petitioners is that the petitioners participated in the selection process for the post of Grade-II Police Constable towards the vacancies for the year 2019-2020. As per the Notification No.1/2019 dated 06.03.2019, the petitioners have sent applications through online and the same were accepted by the respondent. The petitioner appeared for the written examination. The result of the above written test was published during the month of September 2019. Shock and surprise, the result of the petitioners were not published and their applications were rejected on the ground that SSLC pass proof certificates were not available. Therefore, the petitioners have made representations on 14.10.2019 and 09.10.2019 respectively to the respondent. However, till date the representation was not considered by the respondent.
Hence, the petitioners have come out with the present Writ Petitions. 4.Learned Special Government Pleader appearing for the Tamil Nadu Uniformed Services Recruitment Board filed counter affidavit and relevant paragraph is extracted hereunder: "9.It is further submitted that out of the aforesaid 15 writ petitioners, 13 writ petitioners have secured the required cut off marks and hence, they will be allowed to appear for the physical test subject to production of necessary required certificates within the stipulated time period. The remaining two writ petitioners viz., M.Murali - W.P.No.29720 of 2019 and K.Boopathy - W.P.No.29873 of 2019 did not secure the required cut off marks in their respective community and hence, they are not eligible for the further process of selection of physical test."
5.In view of the above, this Court hereby directs the respondent to call the petitioners in W.P.Nos.29868, 29870 and 29871 of 2019 to appear for the physical test subject to production of necessary required certificates. With the above direction, W.P.Nos.29868, 29870 and 29871 of 2019 stand disposed
of. Insofar as the petitioner in W.P.No.29873 of 2019 is concerned, learned Special Government Pleader appearing for the respondent submitted that the respondent has rejected the petitioner's application on the ground that he did not secure the required cut off marks. Recording the said submission, W.P.No.29873 of 2019 stands dismissed.
