ORDER
This application has been filed by the applicants/plaintiffs seeking to sue the respondent/defendant in respect of Item Nos.2, 3 and 4 of the suit schedule mentioned properties on the file of this Court. 2.
According to the applicants/plaintiffs, they filed the suit for
preliminary decree of partition, separate possession and mesne profits. The suit schedule mentioned property viz., Item No.1 is situated within the territorial jurisdiction of this Court and the properties viz., Item Nos.2, 3 and 4 are situated outside the jurisdiction of this Court. Therefore, the applicants/plaintiffs filed this application seeking to grant leave to sue the respondent/defendant in respect of Item Nos.2, 3 and 4 of the suit schedule mentioned properties.

Considering the reasons stated in the affidavit that the property viz., Item No.1 is situated within the territorial jurisdiction of this Court and the properties viz., Item Nos.2, 3 and 4 are situated outside the jurisdiction of this Court and substantial part of cause of action arose within the jurisdiction of this Court, and considering the facts and circumstances of the case, this Court is inclined to allow this application. 4.
Accordingly, this application is allowed. No costs. 12-09-2025 MSM Note: Registry is directed to number the Suit and if it is otherwise in order.
