ORDER
The above writ petition is filed to quash the order passed by the 2nd respondent dated 01.08.2025 and consequently to direct the 2nd respondent to issue an appointment order for the post of Assistant Inspector in Local Fund (Audit (Group-IIA) within a stipulated time frame.

The petitioner would submit that he is an ex-service man and had applied for the post of Assistant Inspector in Local Fund Audit (Group-IIA) notified by the respondents on 20.06.2024 in Notification No.8 of 2024. The petitioner had secured Rank No.19831A and he was selected for appointment by direct 2/7
recruitment to the said post. He was called for counselling with the requisite documents. On 01.08.2025, the respondent had appeared for counselling with the required documents. The petitioner would submit that he had already disclosed to the respondents about the pendency of F.I.R in Crime No.108 of 2021 dated 09.04.2021 where he had been arrayed as the 2nd accused. The said dispute pertains to a property and a compromise had been reached between the parties. Therefore, the petitioner filed a quash petition before this Court in Crl.O.P.No.12507 of 2025 which was allowed on 24.04.2025 on condition that the petitioner pays a sum of Rs.10,000/- to the Chief Minister's Relief Fund, Tamil Nadu. The petitioner would submit that he had produced a copy of the said order at the time of counselling. However, without proper application of mind, the impugned order has been passed. Hence, the petitioner is before this Court.

3. Heard the learned counsel for the petitioner and the learned counsel appearing for respondents 1 and 2.
4. A perusal of the records would show that under the impugned order, it has been stated that the petitioner's allotment has been withheld for the non-production of the following documents, which is detailed as follows:
Criminal case registered - Punishment awarded - court orders submitted - candidate status to be decided by the commission.
Even prior to the said impugned endorsement, the F.I.R had been quashed by orders of this Court dated 24.04.2025 in Crl.O.P.No.12507 of 2025 in and by which the learned Judge has passed the following order.
"5.In view of the above, the FIR in Crime No.108 4/7
of 2021 on the file of the first respondent, is hereby quashed. The terms of Joint Memo of Compromise shall from part and parcel of this Order. The petitioners shall pay a sum of Rs.10,000/-, (Rupees Ten thousand only) as Costs, to the Chief Justice Relief Fund, Tamil Nadu, forthwith and file a photocopy of the receipt along with a memo reporting compliance the Registry."
It is also brought to the notice of this Court that the amount directed has also been paid into this Court and a Memo has also been filed to that effect on 25.08.2025. The order passed by this Court in Crl.O.P.No.12507 of 2025 dated 24.04.2025 has been produced before the respondents. Despite which, the impugned order has been passed.
