PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to disburse the difference sum of interest paid towards the belated disbursement of petitioner's commuted value of pension with further interest at the rate of 6% per annum from the said date of entitlement to till the date of actual payment within a time limit.

O R D E R

The writ petition is filed for the relief set out herein below: "directing the respondent to disburse the difference sum of interest paid towards the belated disbursement of petitioner's commuted value of pension with further interest at the rate of 6% 1/4

per annum from the said date of entitlement to till the date of actual payment within a time limit."

2. The brief facts which has culminated in the filing of this Writ Petition are set out below:

2.1. It is the case of the petitioner that he was working as Special Grade Driver in the Tamil Nadu State Corporation (Villupuram) Ltd, Vellore Region and retired from service on 31.07.2019. Though the petitioner retired on 31.07.2019, the retirement benefits of Gratuity, Earned leave salary and commuted value of pension had been sanctioned on 22.01.2021 with a delay of 540 days. The Petitioner had filed W.P.No.13686 of 2021 which was disposed of with a direction to the respondent to sanction the belated disbursement of gratuity and earned leave salary with interest, however, with regard to payment of interest on commuted value of pension, the petitioner was disbursed with a sum of Rs.3,846/- only on 22.12.2021 as against the actual entitlement of Rs.45,280/-.

3. The petitioner had made a representation on 25.07.2023 and a reminder on 05.05.2025 to the respondent herein. The representation was received but no action was taken to date. Therefore, the petitioner is before 2/4

this Court.

4. Heard the learned Counsels on either side and perused the records.

5. Considering the limited request of the petitioner and taking note of the fact that the petitioner's representation dated 25.07.2023 has not been considered to date by the Respondents, a mandamus, is therefore, issued to the Respondent to disburse the difference sum of interest paid towards the belated disbursement of commuted value of pension with further interest at the rate of 6% per annum from the date of entitlement within a period of one month from the date of receipt of a copy of this order.

6. Accordingly, this Writ Petition is allowed. There shall be no order as to costs.
