O R D E R
The petitioner herein has been arrayed as one of the accused in Crime No.117 of 2025 for the offences punishable under Sections 191(2), 191(3), 1/4
115(2), 137(2), 103(2) and 190 of BNS, 2023, registered by the respondent police, and seeks bail. He was remanded to judicial custody on 04.07.2025. 2.
The case of the prosecution is that it is a case of retaliatory murder and this petitioner, being a friend of the prime accused, joined the other accused, kidnapped the deceased and done him to death. 3.
The learned counsel appearing for the petitioner submitted that some of the co-accused have already been granted bail by this Court and therefore, on the ground of parity, this petitioner, who has no motive and is only a friend of prime accused, may also be released on bail.
4.
However, the learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner was secured only on 04.07.2025 and the investigation is yet to be completed. Hence, he opposed the grant of bail to the petitioner.
5.
Considering the nature of the offence, the manner in which the murder was committed and the reason for the said murder, this Court is not 2/4
inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed.
