Prayer: Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the District Social Welfare Officer to ensure that an enquiry into the complaint of the petitioner dated 05.06.2024 in Na. Ka No. 1348/A3/2024 dated 16.07.2024 under the Senior Citizens Act is conducted by a jurisdictionally authorized officer other than the 4th respondent and consequently direct the 3rd respondent file a report before the Additional Mahila court in DVA No.39 of 2024 after fair enquiry on the petitioner complaint Na.Ka.No. 1348/A3/2024 under Senior Citizen Act. ORDER
This Writ Petition has been filed for a direction, directing the District Social Welfare Officer to ensure that an enquiry into the complaint of the petitioner dated 05.06.2024 in Na. Ka No. 1348/A3/2024 dated 16.07.2024 under the Senior Citizens Act is conducted by a jurisdictionally authorized officer other than the 4th
respondent and consequently direct the 3rd respondent file a report before the Additional Mahila Court in DVA No.39 of 2024 after fair enquiry on the petitioner complaint Na.Ka.No. 1348/A3/2024 under Senior Citizen Act.
2. Heard the learned Senior Counsel appearing for the petitioner, the learned Additional Government Pleader appearing for the first and third respondents and the learned Government Advocate (Crl.Side) appearing for the second respondent and perused the materials available on record.
3. Without expressing any opinion on the merits of the writ petition, the third respondent is directed to conduct enquiry, after issuance of notice to the petitioner and the fifth respondent and after giving an opportunity of hearing to them, and pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
4. With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed. No costs.
