O R D E R
The petitioners have filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to regularize the services of 41 temporary employees who are members of the petitioner Union within a time frame and to consequently direct the respondents to maintain status quo till regularization.
2.It is the case of the petitioner Union it is the recognized representative Union of the employees of the Vijaya Bank which is a Nationlized Bank. The Union has been demanding the Management of the Vijaya Bank to regularize the temporary employees who have put in considerable period of service. During the year 1996, the Bank took on record temporary employees for appointment on temporary basis through Employment Exchange. As such, there are 41 temporary employees, who were sponsored by the Employment Exchange and selected after interview process. The said 41 employees are working as temporary employees. Whileso, on 25.01.2008, the respondent Bank issued a Recruitment Notification, for the post of Peon overlooking the claim of 41 workmen. Aggrieved by the same, the petitioner has filed this writ petition.
3.The learned counsel appearing for the petitioner fairly submits that after filing of the writ petition, 39 persons were absorbed and their services were regularized, however, the services of two persons namely, S.Stella and Delsi Premila were not regularized. 4.In view of the above, since 39 persons are already absorbed, this Court directs the respondents to consider the case of the two persons, namely, S.Stella and Delsi Premila, on par with the other persons who are already absorbed, if they are otherwise eligible. 5.The writ petition is accordingly closed. No costs.
