O R D E R

The petitioner herein alleging that based on the complaint given by one Chinnasamy, the police is frequently calling him and harassing. There is a dispute regarding administration of the temple between the petitioner herein and the complainant Chinnasamy and his son, who are private respondents 4 and 5. In this connection already a civil suit instituted by the petitioner herein is pending.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that a complaint was given by Chinnasamy on 28.04.2023, which has been taken as CSR and the petitioner was summoned, the petitioner appeared and participated in the enquiry on 31.05.2023. However, the complainant did not turn up, thereafter, the enquiry did not proceed due to non cooperation of the complainant Chinnasamy. The petitioner never been harassed as alleged in the petition. 3.

This Court finds that the person who has set the law into motion by lodging the complaint, is not cooperating for the enquiry. In such 2/4

case, after due notice, the respondent police shall close the complaint if there is no material to take up the investigation for any cognizable offence.
