Captioned 'Civil Miscellaneous Petition' (hereinafter 'CMP' for the sake of brevity) has been filed with a prayer for interim injunction qua alienation of suit property.

2. In C.M.P. No.22152 of 2017 qua possession of suit property an order of status quo was granted way back on 08.03.2016 and the same was made absolute today considering that the main appeal is to be heard out. Learned counsel for sole defendant (respondent in the main appeal before us) submits on instructions that no encumbrance has been created. Recording this submission, considering that it is a specific performance suit and plaintiff has been non-suited, captioned CMP is disposed of as closed. There shall be no order as to costs.
