O R D E R
This Criminal Original Petition has been filed seeking for a direction directing the respondent to alter the FIR in Crime No.165 of 2016 and to conduct the fresh investigation.
2. The learned Additional Public Prosecutor would submit that the criminal case in crime No.165 of 2016, they have completed the investigation and closed the same as charge sheet itself abated, because the accused person died in the accident.
3. The learned counsel appearing for petitioner would submit that on the statement recorded from the witnesses as dictated by them, now the respondent had closed the F.I.R.
4. The learned Additional Public Prosecutor would further submit that after serving the charge sheet notice on 08.08.2019, https://hcservices.ecourts.gov.in/hcservices/
the respondent had also filed a final report before the concerned jurisdictional Magistrate on 20.10.2019 itself.
5. Considering the above submissions, the prayer sought by the petitioner cannot be granted. Accordingly, this Criminal Original Petition is dismissed. However, the respondent is directed to serve the referred charge sheet notice to the petitioner and on receipt of the same, the petitioner is at liberty to approach the Magistrate concerned in the manner known to law, if so advised.
