A.No.7987 of 2019 A.No.7987 of 2019 P.T. ASHA, J, By order dated 19.03.2020 this Court had directed the respondent to furnish security and had also directed the applicant to communicate the said order privately as well as by way of paper publication in any local daily. The said order has been complied with.

2.When the matter was listed before this Court on 05.10.2020 this Court was of the view that there was an excessive attachment since the dues were only a sum of Rs.1,09,718/- whereas the properties were sought to be attached over a sum of Rs.5 lakhs. The applicant has filed a Memo dated 02.11.2020 stating that it would suffice if the attachment is granted only with reference to Item-1 of the schedule mentioned properties. 3.Considering the fact that despite notice being served the respondent had not entered appearance either in person or through pleader before this Court, the Item-1 of the schedule mentioned properties shall be attached till the enforcement of the Award that may be ultimately passed in the arbitration proceedings.
