The petitioner seeks anticipatory bail in Crime No.376 of 2023, registered under Section 75 of Juvenile Justice (Care & Protection of Children) Act, 2015.
2.Heard the learned counsel for the petitioner, learned Government Advocate (Crl.Side) for the respondent and the learned counsel for the intervenor. 3.The child of the de facto complainant had been admitted to an Institution run by the petitioner herein called the Tiny Todds Therapy Care. The child is just 3 years old. No consent was obtained from the petitioner for the particular manner of treatment to be given to the child. The specific allegation is that the young child was tied with cloth and both the legs and the hands were tied together and was also blindfolded. The learned counsel for the petitioner justifies this particular method of treatment by stating that it is done only for a few minutes and states that no harm would be done. A child who is already suffering from autism would not be able to express the mental torture and agony which he/she goes through when the young child is restrained like this. Further even a normal child of the age of 3 years would not be able to express his/her agony if treated like this.

kp 4.I wonder whether the petitioner would come forward to tie his own child or grandchild aged about 3 years in this manner and state that the child would not be put to any harm or that no injuries would be caused. It is specifically stated that there are no CCTV cameras to monitor the functioning of this School. Entire aspect requires investigation, I am not inclined to grant anticipatory bail, petition stands dismissed. 5.Accordingly, this criminal original petition stands dismissed.
