ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.07.2025, for the offences punishable under Sections 294(b), 323 of IPC in Crime No. 371 of 2019, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused had quarrel with the defacto complainant and also attacked him. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence, however, he is suffering incarceration from 08.07.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.side) appearing for the respondent police, submitted that NBW was issued against the petitioner on 21.08.2024 and the same was executed on 08.07.2025. He also submits that there are sixteen previous cases pending against the petitioner. Hence, he strongly opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. The petitioner is an habitual offender, who had jumped bail, was secured after issuance of Non Bailable Warrant. He had been absconding for more than a year and only now, he has been secured. Since his conduct does not inspire confidence that he will co-operate with the trial, this Court is not inclined to grant bail to the petitioner.
