The petitioner was arrested on 23.01.2025 for the offence under Section 65 (2) of BNS, Section 5 (m) and 5 (l), 4 (2) of POCSO Act, 2012 in Cr.No.02 of 2025.

2.The victim girl had stated to the Magistrate about the penetrative sexual offence committed by the petitioner by exposing her to obscene video clippings. Hence, the case.

3.The learned counsel for the petitioner states that the petitioner is an innocent person and has been falsely implicated in this case. He further submits that the petitioner has been in judicial custody from 23.01.2025. Hence, prays for grant of bail to the petitioner.

4.The learned Government Advocate (Criminal side) appearing for the respondent Police states that the final report has been filed and taken on file by the Special Court for POCSO offence in Spl.SC.No.28 of 2025 and the matter is posted on 26.08.2025 for framing of charges. Hence, opposed for grant of bail to the petitioner.

5.Heard the learned counsels on either side and perused the materials available on record.

6.Considering the gravity of the offence committed by the petitioner which is reflected from the statement of the victim girl, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
