The application is filed to order payment of a sum of Rs.2,46,522/- standing to the credit of A.No. 8117 of 2018 as Court deposit by issue of cheque in favour of the applicant.

2. This Court by order dated 27.9.2019 allowed the application in A.No.8117 of 2018 thereby salary of the second respondent has been attached and the Garnishee was prohibited from making payment upto a limit of Rs.4,31,605.61 to the second respondent.

According to the applicant, as on date, a sum of Rs.2,46,522/- is available in the credit of A.No.8117 of 2018. Therefore, the present application has been filed to withdraw the said amount.

3. Despite notice served and name of the respondent is printed in the cause list, none appeared before this Court which shows the respondent is not interested to contest the case.

4. This Court is satisfied with the averments made in the application and therefore, the application is ordered as prayed for.
