O R D E R
This writ petition has been filed, directing the respondent to remove the transformer installed in the petitioner's house at Door No.237, Kosapalayath Street, Kattampoondi, Thiruvannamalai District by forthwith.
2. The case of the petitioner is that the petitioner's father purchased a property comprised in Survey No.62/14A Grama Natham, Katampoondi VIlalge, to an extent of 910 sq.ft. of house site by way of a sale deed dated 20.09.1989 and from the date of purchase, he is in possession of the same along with his family. Whileso, the 4th respondent have installed 11 kilo voltage transformer with 109.63 KVA in the rest of his place on 01.06.2023 without any notification and without any permission from the petitioner. Hence the petitioner made a representation dated 30.06.2023 to the 4th respondent to remove the transformer and also made representation to the respondents 1 to 3. But the same was not considered till date. Hence the present writ petition is filed.
3. The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the 1st respondent to consider the petitioner's representation within a reasonable time.
4. The learned standing counsel appearing for the respondents would submit that they will consider the petitioner's representation and pass appropriate orders within a reasonable time as fixed by this Court. 5.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 4tht respondent to consider the representation of the petitioner dated 30.06.2023 on merits and in accordance with law and pass appropriate orders, within a period of four (4) weeks from the date of receipt of a copy of this order,
