ORDER

This contempt petition has been filed for the alleged disobedience of the orders of this Court dated 03.11.2022 made in W.P.No.29187 of 2022.

2. Pursuant to the order dated 02.12.2022, Dr.M.Soundararajan, Registrar of the respondent University is appeared before this Court, his presence is noted.

3. Ms.S.Bhuvaneswari, learned Standing Counsel for the respondent University submitted that, pursuant to the order passed by this Court on 03.11.2022 in W.P.No.29187 of 2022, the web portal of the University was kept open for two days i.e. 28.12.2022 and 29.12.2022.

4. However, Mr.S.Udaya Kumar, learned counsel appearing for the 2/6

petitioner would submit that, through the University web portal only students can be admitted and to be enrolled with the University, merely because only two days it was opened, 30 students alone were able to get enrolled. Insofar as the remaining students are concerned, they could not be enrolled by the petitioner institution, because, the web portal was closed at 8.00 p.m. on 29.12.2022, therefore to that extent the respondent University has violated the orders of this Court.

However, Ms.S.Bhuvaneswari, learned Standing Counsel appearing for the respondent University would submit that, if at all the petitioner has got admission to the full strength of 100 students that is the sanctioned strength of the petitioner institution is concerned, the web portal need not be once again opened only for the purpose of the petitioner institution for further period, instead, if the students have already got enrolled or being enrolled, the list of the students can be presented before the University within a time frame to be stipulated by this Court and that would be considered and enrolled by the respondent University for getting them registered for the academic year 2022-2023.

6. I have considered the said submissions made by the learned 3/6

counsel appearing for both sides and having regard to the aforesaid development taken place, this Court feels that, without further keeping the matter pending and in order to give a quietus to the issue, a direction can be given, under which, the petitioner institution can send the list of 100 students admitted or being admitted in the petitioner institution for the academic year 2022-2023 on or before 31.01.2023 to the respondent University.

7. It is made clear that, the said list of 100 students must include the 30 students already been admitted through the web portal which was opened by the respondent University on 28.12.2022 and 29.12.2022.

On receipt of such list of students from the petitioner institution, the respondent University shall verify their eligibility as per the University norms and accordingly register the names in the rolls of the University for the purpose of continuing their education at the petitioner institution for the academic year 2022-2023 and a communication to that effect shall be made by the respondent University to the petitioner institution thereafter within one month i.e. on or before 28.02.2023. 4/6

It is made clear that, in between, after submission of the list by the petitioner institution as indicated above, if any further input or particulars about any student or students is required by the University, that can immediately be intimated by the University to the petitioner institution, who on receipt of such communication shall furnish such additional particulars or clarifications to the University forthwith and thereafter the needful as indicated above shall be completed by the respondent University within the time frame.

10. With this direction, this Court feels that this contempt petition can be closed, accordingly it is closed. The appearance of the 2nd respondent/Registrar is therefore dispensed with. 11.01.2023 Index : Yes / No Speaking Order : Yes / No Sgl 5/6
