It is stated by the learned counsel for the applicant that the order dated 17.11.2023 passed by this Court in the above application has been complied with by paying cost to the Cancer Institute, Adyar, Chennai and he has also filed a Receipt dated 28.11.2023 in this regard.

2.In view of the statement made by the learned counsel for the applicant and the memo filed, the exparte order dated 05.04.2022 passed by this Court in the above Suit is set aside.

3.Post the main Suit for framing issues on 03.01.2024.
