This application has been filed seeking to condone the delay of 555 days in filing the written statement of defendant in the above suit.

2. The defendant was permitted to file written statement on payment of Rs.10,000/- payable to Adayar Cancer Institute, Chennai, the same is paid. Therefore, considering the nature of delay occurred in filing the written statement and considering the fact that the suit is between the husband and wife, in order to give fair opportunity to the parties and adjudicate their rights on merits, this Court is inclined to condone the delay in filing the written statement in the above suit.

3. Accordingly, this application is allowed.
