Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition that the petitioners shall report before the trial court on the first working day of every month at 10.30 am by its order dated 20.04.2018 made in Crl.M.P.No.6006/2018 in Crl.RC.No.498/2018.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MUKUND R. PANDIYAN, Advocate for the petitioner and of MR. M.MOHAMED RIYAZ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- The above petition is filed seeking to relax the condition imposed by this Court on the petitioners vide order dated 20.04.2018 made in Crl.MP.No.6006/2019 in Crl.RC.No.498/2018. This Court, in its order dated 20.04.2019, had suspended the sentence imposed on the petitioners with a direction to report before the Trial Court at 10.30 a.m., on the first working day of every English Calendar Month, pending disposal of the revision. The learned counsel for the petitioner would submit that the petitioners are complying the condition imposed by this Court without fail and the petitioners are senior citizens and that they are suffering from old age ailments and would seek that the condition of appearing before the Trial Court on the first working day of every month, be modified.
Heard the learned Additional Public Prosecutor and also perused the affidavit filed in support of the petition. https://hcservices.ecourts.gov.in/hcservices/
Taking into consideration the age of the petitioners, the condition imposed vide order dated 20.04.2018, is hereby modified. (i) As far as, first petitioner is concern, modified to appear once in two months before the trial court, at 10.30 am on the first working day of particular month starting from January-2020, pending revision.
(ii) as far as, the petitioners 2 to 6 are concern, modified to appear once in three months before the trial court, at 10.30 am on the first working day of the particular month starting from January2020, pending revision. The petition is ordered accordingly.
