Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus forbearing respondents 1 to 4 from granting of any permission for any events, tournaments, functions etc. other than those organized by the fourth respondent school and consequently direct the respondents to safe guard the Tiruporur Government Boys Higher Secondary school playground from any unauthorized use.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.G.R.Hari, learned counsel for the petitioners and Mr.P.Harish, learned Government Advocate for the respondents.

2. The petitioners seek direction against the respondents from granting any permission for any events, tournaments, functions etc. other than those organised by the fourth respondent school, and further seek directions against the respondents to safeguard the Tiruporur Government Boys Higher Secondary School playground from

any unauthorised use.

3. Learned counsel for the petitioners submits that private persons are conducting tournaments for their own benefits. The authorities are permitting the same to the detriment of the school children.

4. Learned Government Advocate submits that some miscreants had entered into the playground and conducted tournaments. However, the same has now been stopped completely. Gates have been fixed. Now, private persons are not allowed to conduct any tournaments or use the playground for their private purposes.

5. A playground cannot be kept idle. Playgrounds are meant to be used for playing activities, however, in an authorised manner. Private persons cannot barge into the said government school playground and use it for their own purpose. The authorities concerned will have to be diligent and shall supervise that no unauthorised use of the said playground is being undertaken in whatsoever manner.

6. It is submitted that now gates are locked and keys are with the headmaster of the boys school. The headmaster of the school or any officer of the school may immediately report if any such private entities or persons are using the said playground for their private purposes.

7. The writ petition is accordingly disposed of. There shall be no order as to costs.

8. WMP No.30187 of 2022 filed to permit the petitioners to join together and file a single writ petition is allowed and disposed of. (S.V.G., CJ.) (J.S.N.P., J.) 02.04.2024 Index : Yes/No : Yes/No tar
