Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing 1st and 2nd respondents herein to take action against 5th respondent pursuant to the petitioner's representation dated 19.12.2016.

ORDER

Claiming the community certificate of the fifth respondent herein to be bogus, the petitioner seeks for further action to be taken against the fifth respondent herein. Earlier on 19.12.2016, the petitioner has given a representation to the first respondent herein, on the same cause of action. Her representation has been forwarded to the second respondent herein on 29.12.2016.

2. This Court is of the view that any action to be initiated against the fifth respondent, would be based on certain factual aspects and it would be the second respondent who can make the appropriate order to act on the petitioner's grievance. Since her representation is under consideration 2/4

before the second respondent herein, it would be appropriate to direct the second respondent to pass final orders on the representation, after giving due opportunity to the fifth respondent also.

3. Accordingly, there shall be a direction to the second respondent herein to consider the petitioner's representation dated 19.12.2016 that was forwarded by the first respondent herein, in his proceedings in O.M.No3513/A3/2016 dated 29.12.2016 and pass final orders, after affording due opportunity to the fifth respondent, within a period of twelve

(12) weeks from the date of receipt of a copy of this order, if not already disposed of.

4. With the above direction, this Writ Petition stands disposed of. No costs.
