Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, praying to direct the respondents' police to provide adequate police protection to the petitioner and her family members to cultivate the land in Survey No.3/2C, New Sub Division Survey No.3/2C2, S.No.4/1C, measuring about 2.11 acres, Pappichettipatti Village, Uthangarai Taluk, Krishnagiri District on the basis of the petitioner's complaint dated 05.11.2022 which is on the file of the respondents' police. 1/4

This Criminal Original Petition has been filed to direct the second respondent to provide police protection to the petitioner and her family members to cultivate lands by considering her representation dated 05.11.2022.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2.

The learned counsel for the petitioner submitted that the petitioner is the owner of the subject property and on which, she is trying to cultivate the lands but that was prevented by the opposite party and hence, she has filed this petition seeking police protection. 2/4

The learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2 submitted that on the complaint given by the petitioner, current paper enquiry has been initiated in C.S.R.No.247 of 2022 and it is under consideration.

The allegation made by the petitioner is that she could not do her agricultural activities in her lands in view of the resistance given by the third respondent and his family members. Since the matter is civil in nature, the rightful course open to the petitioner is to file a civil suit for seeking appropriate remedy.

With these observations, this Criminal Original Petition stands dismissed.
