The petitioner, who apprehends arrest at the hands of the respondent Police for the offences under Sections 354A IPC r./w Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.228 of 2023 seeks anticipatory bail.

2. The learned counsel for the petitioner stated that the petitioner is an innocent person and he has been falsely implicated for the offences under Sections 354A IPC r./w Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.228 of 2023. Thus, he seeks anticipatory bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) that the occurrence had taken place on 06.07.2023. The defacto complainant is the mother of the victim, It is stated that the victim is a mentally retarded person and the petitioner appears to have misbehaved with her. She had identified the petitioner. She also had fever and was taken to the hospital. Thus, he prays for dismissal of this petition. https://www.mhc.tn.gov.in/judis 1/2

4. In view of the seriousness of the offence, investigation has to be necessarily conducted, since the child is a vulnerable victim. Therefore, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
