Respondent(s) PRAYER:-Writ Petition filed under article 226 of the Constitution of India, praying for an issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order Na.Ka.No.A5 / 4391 /2025, dated 29/07/2025 passed by the 2nd Respondent and quash the same as aribitrary, unreasoned and void and consequently direct the 2nd Respondent to remove the name of the 4th Respondent and issue patta to the petitioner within a time fixed by this Court.

ORDER

This writ petition has been filed challenging the impugned order dated 29.07.2025 passed by the 2nd respondent, rejecting the petitioner's application seeking for issuance of patta in his name for the property more fully described in the prayer to this writ petition.

2.The petitioner has challenged the impugned order on the ground of violation of principles of natural justice and also on the ground that the same has been passed by total non-application of mind, to the supporting documents filed by the petitioner.

3.According to the petitioner, the supporting documents filed by the petitioner has not been considered by the 2nd respondent while passing the impugned order. According to the petitioner, if the same was considered, the petitioner would have been entitled for grant of patta. In the impugned order, the petitioner's application has been rejected on the ground that the supporting documents relating to the 4th respondent has not been produced by the petitioner.

4.Learned counsel for the petitioner would submit that if the matter is remanded back to the 2nd respondent, the petitioner will furnish all the documents to substantiate his case for the grant of patta. 5.Notice sent to the 4th respondent (Sarojini) has been returned as unserved with an endorsement "refused", which amounts deemed service. The name of the 4th respondent is also printed in the cause lists. 6.Since the petitioner is willing to produce all the required documents before the 2nd respondent, this Court deems it fit to remand the matter back to the 2nd respondent for fresh consideration on merits and in accordance with law, after hearing the objections of the 4th respondent and any other third party whom the 2nd respondent deems it fit to enquire.

7.This Court is not expressing any opinion on the merits of the petitioner's application seeking for issuance of patta. 8.For the foregoing reasons, the impugned order dated 29.07.2025 passed by the 2nd respondent is hereby quashed and the matter is remanded back to the

2nd respondent for fresh consideration on merits and in accordance with law, after hearing the objections of the 4th respondent or any other third party whom the 2nd respondent deems it fit to enquire, within the time frame to be fixed by this Court. The 2nd respondent shall pass final orders within a period of twelve

(12) weeks from the date of receipt of a copy of this order, after giving due consideration to the documents produced by the petitioner and the 2nd respondent shall pass speaking order after hearing the objections. 9.With the aforesaid directions, this writ petition is disposed of.
