The petitioner herein seeks anticipatory bail in Crime No.34 of 2023 registered by the respondent Police for the offences under Sections 3(2)(a), 4(1), 5(1) Immoral Profit and Prevention Act.
2. The learned counsel for the petitioner stated that he has been falsely implicated as an accused in this case. The petitioner is the owner of the Gold Guest House, Koyambedu, Chennai. It is stated that the petitioner belongs to a very respectable family. He is innocent. He further stated that the 3rd accused had been granted bail. Thus, he seeks bail to the petitioner.
3. The learned Government Advocate (Criminal side) states that the Gold Guest House, Koyambedu, Chennai was used for prostitution. The victim girl was rescued by the respondent police. Thus, he prays for dismissal of this petition.
4. It is stated that the 3rd accused had been granted bail. The 3rd accused is only a broker, however, the petitioner herein is the owner of the 1/3
guest house. He should be aware of the activities carried out in his hotel. He cannot make money by using his place for committing prostitution.
4. Taking the facts into consideration, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
