The petitioner/A2, who was arrested and remanded to judicial custody on 18.05.2024 for the offences under Sections 8(c), 20(b)(ii)(B), 22(c), 25, 29(1) of the NDPS Act, in Crime No.339 of 2024, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner, along with the other accused, were found in illegal possession of 2 kg of Ganja and 53 grams of Methamphetamine powder. Hence the case.
3. Learned counsel for the petitioner/A2 submitted that the petitioner is an innocent person; he has not committed any offences as alleged by the prosecution. He also submitted that the co-accused in this case were granted bail. He further submitted that the petitioner is a law-abiding citizen; that he is ready to furnish substantial sureties for his due release on bail; and that he is ready to abide by any condition that may be imposed by this Hon'ble Court and therefore, he prayed for the grant of bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police opposed granting bail to the petitioner by stating that the petitioner, along with the other accused, were found in illegal possession of 2 kg of Ganja and 53 grams of methamphetamine powder; that though there are no previous cases pending against the petitioner, the contraband recovered from the petitioner is a commercial quantity; and that the investigation is in the preliminary stage.
5. Heard both sides and perused the materials available on record.
6. Considering the representation made by both sides, that the investigation has not yet been completed, that the quantity of contraband involved in this case is also a commercial quantity and also considering the gravity of the offence, this Court is declining to grant bail to the petitioner at this stage.
