ORDER

The present revision has been filed by the defendant seeking for direction to the Sub Court, Kancheepuram, to dispose of the suit initially Page No.1 of 4

filed for a relief of permanent injunction, which was subsequently amended to one for declaration, in O.S.No.444 of 2023, pending on its file.

2. Considering the limited request made by the petitioner, notice to the respondent is dispensed with.

3. Learned counsel for the revision petitioner submits that though the suit is pending in O.S.No.444 of 2023, however, the said suit has been originally filed in the year 2018 in O.S.No.120 of 2018 before the District Munsif cum Judicial Magistrate Court, Sriperumbudur and later, the same was transferred to the file of the Sub Court, Kancheepuram and was renumbered as O.S.No.444 of 2023. Learned counsel further submits that, the petitioner has come up with the present revision seeking speedy disposal of the above said suit on the ground of his advanced age and failing health condition, as the said suit is kept pending for the past about seven years.

4. In the light of the above, this Court directs the Sub Court, Kancheepuram to dispose of the suit in O.S.No.444 of 2023 finally on merits and in accordance with law on or before 31.12.2025, after hearing the parties.

5. Accordingly, this Civil Revision Petition stands disposed of. No costs.
