The complaint has been filed by the Aunt of the accused alleging that the accused demanding Rs.5 lakhs to go abroad had attacked her with rod 1/4

which caused bleed injury.

The learned Government Advocate (Crl.Side) appearing for the State submits that the case has been registered in Crime No.33 of 2023 under Sections 294b, 324, 506(ii) of IPC and Section 4 of TNPHW Act by the respondent police. The wound certificate is awaited for filing the final report.

Considering the nature of the complaint and the injury alleged to have been caused by the petitioner herein, it cannot be taken as foisted case or a civil dispute. Hence the Criminal Original Petition to quash does not fall within the parameter laid by the Hon'ble Supreme Court. 4.

In view of the above, this Criminal Original Petition is dismissed. Consequently, the connected Criminal Miscellaneous Petition is also dismissed.
