The petitioner in the affidavit filed in support of the miscellaneous petition has stated that he is a senior citizen and due to health complications he was not in a position to file appeal suit within the time prescribed.

In view of the reasons stated in the accompanying affidavit filed in support of the petition, delay is condoned and this miscellaneous petition stands ordered.
