Chetanbhai Sureshbhai Majithiya v. The State Rep By Its,
Crl.OP.No.23425 of 2023 Crl.O.P.No.23425 of 2023 C.V.KARTHIKEYAN,J.
The petitioner seeks anticipatory bail in C.C.No.85 of 2015 in which he has been absconding from 14.10.2019. As a matter of fact earlier Non Bailable Warrant was issued on 14.10.2014. The petitioner is the first accused.
2. It is stated that he was in found in possession of 145.715 kgs of Sandalwood. There are two other accused. Since the petitioner had absconded and did not participate in the trial, the case was split up as against the petitioner as C.C.No.85 of 2015 and as against other accused as C.C.No.147 of 2015. Again, the petitioner had absconded from trial and second Non Bailable Warrant has been issued. Hence, anticipatory bail is not maintainable.
3. Accordingly, this Criminal Original Petition is dismissed. 12.10.2023 nst/vv https://www.mhc.tn.gov.in/judis
